All orders for goods or services accepted by Az-U R Designs (June Doughty-Stapleton, Trading/As “Az-U R Designs”) are accepted subject to the following conditions which shall form part of and govern the contract and agreement of sale. Acceptance of goods shall be deemed to be acceptance of these conditions of sale.
1. Payment and Price: On-line secure payment for goods are encouraged via the Pay Pal service provided. Pay Pal's own Terms and Conditions apply. (a) Price Lists do not constitute an offer. (b) Goods dispatched when payment method is cleared. (c) Invoiced goods are due for payment on the date of invoice. (d) Payment to be made in £ sterling. (e) Orders paid by cheque, will be dispatched once payment has cleared, (please allow up to 14 days). Cheques may clear sooner if a valid cheque guarantee card number and expiry date are written on the reverse of the cheque issued. Cheques should be made payable to J E Doughty-Stapleton. (f) Cash is not accepted by post or carrier. Postal/Money Orders only £ Sterling, Postal Orders accepted. Please cross the order with the words A/C PAYEE ONLY. Postal/Money Orders should be made payable to J E Doughty-Stapleton. 2. Availability of Goods. Items priced do not mean goods are in stock. Az-U R Designs endeavors to comply with the date named for dispatch or delivery. The date given for dispatch is intended as an estimate only and is not to be the essence of agreement and contract of sale. If owing to non-availability of goods or any other cause beyond Az-U R Designs control, Az-U R Designs shall be unable to affect delivery, and accepts no liability. The customer will be informed immediately of non available goods. Non available goods will be refunded in full. Customers will be informed via email regarding dispatch of goods. If the customer is unable to accept delivery of goods, an alternative delivery date may be arranged or a full refund offered. 3. Delivery of Goods. Az-U R Designs endeavors to dispatch on-line orders within 7 working days. Certain items may be delivered direct from other suppliers. These items may take between 10-28 days. These items are described (T-shirts, books by other authors, and occasionally there may be delays from suppliers of card and envelope stocks) the customer will be provided with an estimated delivery date for the items along with an option to cancel within 24 hours of placing the order, (longer over weekends and public holidays). If items are temporarily out of stock and dispatch is anticipated to be after the 7 day period the customer will be contacted by email or phone to agree on a new delivery date. If this date is unsuitable, a full refund will be offered. 4. Property and Risk. (a) For so long as any amounts remain owing from the purchaser to Az-U R Designs (whether immediately due or not) title to the property of the goods shall remain that of Az-U R Designs and ownership will not pass to the purchaser until payment is received in full. (b) In all cases, (unless formally agreed) Copyright of the images and designs remain the property of June Doughty-Stapleton, Az-U R Designs, and reproduction, copying duplication, uploading and downloading of these copyright images, in any form may not be carried out without the consent of June Doughty-Stapleton, Az-U R Designs. All rights reserved. 5. Product Information. Product images, descriptions and approximate dimensions have been designed to give as much information as possible about the product; these are meant as a guide. The product images are not displayed to actual size. Where necessary the products approximate dimensions will be shown. Cards are decorated and cut by hand and there will be slight variations in size and hand applied decoration. Card Sizes A6 (105 x 148 mm), A5 (148 x 210 mm), Square (140 x 125 mm); Prints and Poster sizes, A4 (210 x 297 mm), A3 (420 x 594 mm), the sizes, image coloration and decorative description are used for guidance purposes only. Additional product information can be requested at any time. 6. Claims. (a) No liability for any claim for damage or non-functionality shall be accepted unless the purchaser notifies Az-U R Designs in writing (via post or electronic mail) within a reasonable time after delivery. (b) No liability for any claim will be accepted in the case of goods differing in size or descriptions from the particulars given on the invoice/delivery note unless Az-U R Designs is notified in writing by the purchaser within a reasonable time of delivery and the onus is on the purchaser to prove any shortage. This does not affect your statutory rights as a consumer. 7. Consumer Protection (Distance Selling) Regulations 2000. All purchases made via the On-line Shop whether placed by Telephone, Email or mail order, are subject to the UK Distance Selling Regulations. o You have the right to cancel your order and receive a full refund with no financial penalty for any item or services. Certain exemptions apply: Computer Software where the protective seal has been broken and perishable items such as fresh flowers, and personalised items. o You may cancel your order by sending or delivering to Az-U R Designs an, e-mail or cancellation letter at any time up to and including seven days after the day on which you receive your purchase (excluding Saturdays, Sundays and Public Holidays). Returned Goods. Not covered by Distance Selling Regulations (section 7 above). (a) Goods made to your personal specifications (b) The vendor will not accept goods for credit or refund unless such return has been authorized by Az-U R Designs, and the goods are received by Az-U R Designs in stock condition, with original packaging. (c) The purchaser shall unless otherwise stated, or goods are being returned under the Distance Selling Regulations be responsible for the cost of outward and return carriage and insurance of all goods returned by the purchaser to Az-U R Designs for refund or credit which goods shall be at the risk of the purchaser until actual receipt of the goods by Az-U R Designs. The onus of proof of safe delivery shall rest with the purchaser. (d) Az-U R Designs will refund postal expenses on returns of faulty or incorrectly supplied goods. (e) No credit or refund shall be made for goods until they have been received complete. 9. Complaints Procedure. Az-U R Designs endeavors to respond to complaints within five working days. Complaints will be dealt with confidentially and in a fair, speedy and effective manner.
